Roby is a financial illustration tool. It is not a substitute for professional financial, legal, or tax advice. Do not make housing or investment decisions based solely on this app's output.
1. Acceptance of Terms
By downloading, installing, or using Roby ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Roby is a financial illustration and calculator tool that compares the estimated financial outcomes of renting a home and investing the difference versus purchasing a home. The App produces mathematical projections based on the inputs you provide and publicly available housing data.
3. Not Financial Advice
This is the most important section of these Terms.
The App does not provide financial advice, investment advice, tax advice, legal advice, or any other form of professional advice. All output produced by the App — including but not limited to net position projections, break-even calculations, monthly cost comparisons, and "Explain It" breakdowns — are mathematical illustrations only.
Specifically:
- The App's calculations are estimates based on simplified models. Real-world outcomes will differ due to factors the App does not and cannot account for, including but not limited to: changes in tax law, local housing market conditions, individual creditworthiness, employment changes, life events, inflation variability, and market volatility.
- The App does not know your complete financial situation, risk tolerance, goals, or personal circumstances.
- The App's projections assume constant rates of return, appreciation, and rent growth over the entire projection period. Actual rates will vary, sometimes dramatically.
- State-specific default data (property tax rates, insurance costs, median home prices) is derived from publicly available sources and may be outdated, inaccurate, or inapplicable to your specific property or location.
- You should always consult a qualified financial advisor, tax professional, or attorney before making decisions about renting, buying, selling, or investing.
4. Limitation of Liability
To the maximum extent permitted by applicable law:
- The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Joshua Hart ("the Developer") does not warrant that the App's calculations are accurate, complete, reliable, current, or error-free.
- The Developer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the App, including but not limited to financial losses resulting from housing, mortgage, investment, or other financial decisions made in reliance on the App's output.
- In no event shall the Developer's total liability exceed the amount you paid for the App.
5. Assumption of Risk
You acknowledge and agree that:
- Purchasing a home is a significant financial decision that carries substantial risk.
- Investment returns are not guaranteed and you may lose money.
- You are solely responsible for any financial decisions you make, whether or not you used the App in making those decisions.
- You will not rely on the App as your sole or primary basis for any financial decision.
6. Data Accuracy
The App uses publicly available data from third-party sources including, but not limited to, the Tax Foundation, the National Association of Insurance Commissioners, and Zillow. The Developer does not guarantee the accuracy, completeness, or timeliness of this third-party data. Default values are provided for convenience and may not reflect current or local conditions.
7. User Conduct
You agree not to:
- Use the App for any unlawful purpose
- Reverse engineer, decompile, or disassemble the App
- Redistribute, sublicense, or resell the App
- Represent the App's output as professional financial advice to others
8. Intellectual Property
The App and all of its content, features, and functionality — including but not limited to its design, code, graphics, and the Roby name and logo — are owned by Joshua Hart and are protected by copyright, trademark, and other intellectual property laws.
9. Third-Party Services
The App is distributed through Apple's App Store. Your use of the App is also subject to Apple's Licensed Application End User License Agreement (the "Standard EULA"). In the event of a conflict between these Terms and Apple's Standard EULA, these Terms shall govern to the extent of the conflict with respect to the App's content and functionality.
10. Privacy
Your privacy is important. Please review our Privacy Policy, which explains how the App handles (and does not collect) your information.
11. Changes to These Terms
The Developer reserves the right to modify these Terms at any time. Changes will be posted on this page with a revised "last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
12. Termination
The Developer may terminate or suspend your access to the App at any time, without notice, for any reason. Upon termination, your right to use the App ceases immediately.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which the Developer resides, without regard to conflict of law principles.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
15. Entire Agreement
These Terms, together with the Privacy Policy and Apple's Standard EULA, constitute the entire agreement between you and the Developer regarding the App.
